Claim Preliminaries

Dear All,

Our Contact is a Item rate Contract.Scope includes Structure ,Finishing & MEP.

Preliminaries cost is provided in the contract only for structures which is 5% of Structure Contract Value.

Now we made a claim for preliminaries  for MEP & Finishing.Calculation is based on the same percentage (5%) on Finishing & MEP Contract Value.

Delay claims (Loss and Expense)

Hudson , Emden and Eichleay Formulae

Which one is more suitable for EOT claims for loss and expense ?

Other than the formulae , are there any other method to calculate, like based on actual ?

I heard Pro-rata prelim claim is not a recognised concept in dealing with loss and expense arising from delays.  

Anyone to advice the approach.

EOT on design issues

I have encounter below case. Kindly advice.

 

The scope of work is the roof trellis at lvl 35.

3 person involved:

Main Con

Sub Con (Trellis Specialist)

Architect

Scenario

1) Main Con issue the structural and architectural layout drawing at level 35 late

2) issues with design submission

  2.1- This is where the disputed started

  2.1 - Sub Con is saying architect took a long time to review and comment. Comment are too vague and they are many revision.

Delay Analysis Case Study

Hi there,

I'm new in both in this forum and also in planning. I'm doing my masters thesis in Schedule Delay Analysis. I'm in dire need of a case study for delay analysis that consist of as-planned as well as as-built schedules and also all the records (MOM, DPR etc.) reagarding all the delays happened in the ite for that particular project.

So please can somebody help me with my case study by sharing already analyzed projects or projects schedules with all the records??? I don't need a big project. Small projects will be okay.

Hi all,

I have the following questions?

1. Can an increase in quantities entitle contractor to EOT?

2. Can a contractor lose his right if there is a delay in design drawings wnen he decided to start construction on his risk?

3. Which is the best time impact analysis used in EOT?

Hi there. (apologies in advance for the long winded article)

I am currently working on rebutting a Contractors claim. 

The Contractor has presented the delay analysis using a Time impact analysis to demonstrate the effect of the Employers delaying events.  I am pretty certain that in a lot of the cases the Contractor was concurrently in delay but need to prove it.

I am looking to adopt a Windows as planned Versus As built analysis to assess what the Critical path was on a monthly basis, i plan to do this as follows;

Removing Constraint from Approved Baseline

Hi,

A friend of mine working with a consultant, has a claim from the contractor. The client on the submission of the design drawings recommended a change within the 28 days of the submission. The contractor resubmitted the design and after a long period of arguments from both the sides the employer approved the original design submitted by the contractor.

Now the contractor claimed an EOT of 69 days when my friend inserted the delay in critical path that has a constraint the approved baseline, it showed the same but when he removed the constrained the delay was just 30 days.
