Statutory undertaker

Hi,

The contractor was handed over the land to build the road for the govt. agency. Some utilities need to be shifted in which statutory undertakers (SU) were involved. As per the contract, the contractor needs to pursue the matter with the SU for obtaining the necessary permits even though there was no direct contractual liability for the SU in the agreement between the govt agency and us. Now we are delayed due to the delay in obtaining permission.

What I want to know is:

EOT for a Particular Section of the Road

Dear All,

I have a problem related to an EOT Claim. Our project is a 10 Km long Highway & there are no sectional project completion dates as per contract.

Currently, work is in progress but behind the schedule. Unfortunately, at the very end sections of the project, we encountered a Unforseen Physical obstruction. So that, now the Engineer is planning to grant a EOT for that particular section (0.50Km) only & has instructed to the contractor to complete the other works (9.50Km) as per contract.

External development Work

Dera All,

Our Contract is an item rate contract . Scope of External development work (Like land scape,Hard scape ) through some specialised agencies & we are getting a fixed fee on that.

Now client issue us a BOQ for Bounday wall which was not covered in Orginal BOQl. PMC is telling Construction of Boundary wall   not come in External development work & insisting us to  execute  the item  based on existing BOQ rate in Contract.Whether construction of Boundary wall,Guard room,Gates grill will come under external development work???

Subcontractor delayed and faces LD's but entire project not affected

Hi guys,

I offer following situation for your review and advice :

Subcontractor's scope is part of a larger project involving other subcontractors. Subcontractor has caused a delay to the completion of its scope which would enable Contractor to draw liquidated damages as per the Contract.

FIDIC Clause 20.1

 Hi All

I have doubt in FIDIC 1999 clause No. 20.1 “Within 42 days after receiving a claim or any further particulars supporting a previous claim or within such other period as may be proposed by the Engineer and approved by the Contractor.”

The clause can be interpreted as

Within 42 days after receiving a claim or within 42 days any further particulars supporting a previous claim or. . . “

Please clear my doubt
