Is the delay excusable?

Our contractor is building a office block. The structural steel was scheduled to arrive on site in the 12th week, but the nominated supplier delivered it two weeks late.

The contractor missed the milestone for completing the steel frame, pushing back mechanical, electrical, cladding trades. I am tasked to write a simple report to answer the Engineers challenge of "Is this delay excusable (entitling the contractor to an EOT), or is it non‑excusable (i.e. our contractor’s risk)?

IChemE Burgundy - EOT Adjustment Baseline (Principles / Process)

Hi all, Working for a Contractor on a project using IChemE Burgundy contract, having worked mostly on projects using NEC Contracts..... There doesn’t appear to be any specific information within the Contract as to the correct process of preparing a impact quotation for EOT Adjustment (i.e. NEC clauses (/ guidance notes) state using the Approved Programme, and impact against remaining works (having added progress achieved, up to the Event) etc.

How to force an activity on the critical pass

Dear All,

i have read a topic about delay analysis mentioning one of the tricks that the contractor use to his favor when issuing a claim.

That to sequence the activities that are potentially can be delayed by the owner so that the critical path pass thorough these activities.

Does anyone know hoe to practically apply this , a trick to force an activity on the critical path?.

Costain vs Haswell Revisited

Our latest blog post looks at the 2009High Court judgement: Costain Ltd v Charles Haswell & Partners Ltd [2009] EWHC B25 (TCC), through the lens of ‘distributed projects’.  The fundamental problem identified in this judgement was caused by the distributed nature of the project work.
