2 weeks of work, so you give them 4 weeks because you don't want to deal with possible 2nd extension- cost?  - Can you ask or expect only having to pay for 2 weeks of overhead for 4 weeks of work - for the above reason.  Would you be concerned that they agree and then address different legally?

What is to prevent a contractor from dragging out and filing for substantial completion if there was a delay?

What is to prevent a contractor from dragging out and filing for substantial completion if there was a delay?  (To increase length of Overhead claim?)  And or doing added work un-necessarily sequentially etc, not even submitting for SC when they can and having some of the work done in Punchlist?

Projected claim duration vs actual delay duration

Not really a forensic delay but this is the only "claim" section.  There is a delay caused by a design issue, for example in the structural design review a change is made.  A notice of potential claim is filed.  Say the delay at that time is projected at 6 weeks, after the steel arrives and is installed it is 4 weeks.  A claim is filed for 4 weeks and that there will be cost but the cost is unknown.  The project completes 2 weeks late due to the steel.  I have seen where the contractor asks for the 4 weeks and "reserves the right" to the cost once it is determi

NEC 3 compensation event - forgotten impact from a closed CE

Hi,

Good day. A previous CE is already closed with no time impact and only cost implication. The Contractor withdawn its time impact in that CE because of conflict with the PM assessment.

Now, another new related CE is being prepared which includes a forgotten change of quantity which has a time impact (different issue from the conflict) in the previous CE.

Can the Contractor do that or not, include the other changes in the previous CE into the new CE? Any related NEC clause?

Client now delaying Completion Date with Damages (where previously both Client & Contractor have caused delays)

Hi all,

 

I've been tasked with looking at claiming EOT on a contract that's using NEC3 and there are damages attached to the Completion Date - without any real commercial training (so apologies if using incorrect terminology).....

 

The duration has previously been extended - we were cuplerable for some delays and the client for others (resulting in Completion Date and our paid prelimns extending, but not covering the whole period up to our current Planned Completion).

Delay due to advance payment

Hi All ,

I'm working on a project started on 22-Mar-20 , as per the agreed contract ; an advance payment must be paid by the client at the begining of the project .

 

until now the payment still not processed , the contractor is facing a lot of delay due to delay in placing order for the materials to vendors , in this condition the programme is delayed about 3 months.

 

how can I build a claim regarding this matter ?

Weather Delay

We have a contractor who is asking for the time extension due to weather. However, this year 2020 it is observed that there was no extraordinary rainfall.

My question is, what parameter do we consider to calculate anticipated adverse weather day and incorporate in the schedule?

The GC claims that any day with rainfall above 0.25 is adverse rainfall that could stop construction. However, some experts say any day above the monthly average precipitation is considered as adverse weather.
