ADR Dissertation Questionnaire HELP!!

Hi Guys,

Please could you spare 5 minutes of your time to fill out my questionnaire about alternative dispute resolution, i'm struggling to get any replies and i'm in desperate need for this data.

If only part of the questionnaire can be filled in then please do so as this is better than nothing. There is also questions regarding EOT etc which i know is disscued on here alot.

Also if you know of anyone working in this area could you kindly distribute the link to them.

I've attached the link below.

End-of-window (retrospective) validation in TIA with a SRP

O
Ollie Lecm 👤 Member for 6 years 10 months

Hi guys,

I'm working on a project where the contractor issued a schedule recovery plan (SRP) at the end of a certain window. The contractor had impacted Owner's event into the network to determine their EOT entitlement.

My question is: how do we retrospectively validate the impacted results of the window immediately prior to the issuance of SRP when the end-of-window update is the SRP?

Thanks!

Withdrawal by Contractor in the early stage

K
Kannan CP 👤 Member for 17 years 11 months

Hi All,

After the award of Contract and just after the mobilisation time period, the Contractor sent letter to Client stating that they are unable to carry out the works due to some internal issues in the Organization. Also they want a no future claim letter from the Client and not interested to take the money for mobilisation stage (less amount).

In this case with which clause of FIDIC the client can claim (if he intended). and what are the possible scenarios of negotiation for closing this issue. Definitely the Client wants to carry out this Project.

Best Regards

Impacted As Planned (totally ignore as-built dates for completed activities/delay events)?

D
Dj Tron 👤 Member for 6 years 9 months

Hi, I have the ffg. questions if I'm using a impacted as planned technique for my original approved baseline (no progress yet). My project is 60% complete to date but I don't have any good as-built records/monthly progress update. PLEASE REFER TO THE LINK https://imgur.com/a/qdNKugA FOR ILLUSTRATIONS

  • Q1. Can i use my original approved baseline (no progress yet) and totally ignore as-built data/links for other activities before and after the delay event by using planned dates/durations?

Forensic delay analyst/expert witness

Hi,

I'm currently in my last year of uni studying Quantity Surveying and my goal is to get into the dispute resolution/expert witness sector.

I understand this is one of the most lucrative sectors to work in. Also will this role become dispensable with new technologies such as BIM 4 as I don't want to waste time studying something that may be worthless in the future.

Also anyone know how to get into this niche sector?

I'm asking this before thinking of studying my masters in construction law and dispute resolution.
