Entitlement to time

Hi Guys,

 

First post on the forum, have used it many times as a point of reference though!!!

I am currently seeking an Extension of time and am currently in Amicable Settlement with the Employer, they have awarded a very small EOT which we have rejected. Throughout discussions we have have proven entitlement much greater than that awarded.

Time at Large - An alien concept in India

Hi Delay Experts

I have a classic case of time being set at large in a delay claim in India.

I would have no problem promoting this in UK but nobody seems to have heard of the process in India.

I can also demonstrate that the situation is covered by the India Contract Act 1872.

Has anybody had any similar experience that they could share with me?

concurrent delay, who is responsible the contractor or Employer

Regarding the concurrent delay, who is responsible the contractor or Employer. If a contractor raises the EOT based on concurrent delay with the employer, then what would be the determination reslut? whether employer has to bear the cost or the contractor? as per Fidic.

Cl 14 Fidic conditions for Master program

In one of my present project, Cl 14.1 has been approved and subsequently it was revised as per Cl 14.2. Now whether that Cl 14.2 can be considered as a baseline and the same can be considered for calculating EOT if any arises in future or the original Cl 14.1 program has to be compared?

Abortive Works

It is very common that discrepancies are found between drawings.However, if discrepancies are not found and the contractor built something according to either one of the drawing.After that  the contractor found the discrepancies and were told that the works should follow the other drawings. Could the contractor claim for abortive works . It is usually the consultant would say the contractor is obliged to notify him the dicrepancies found and ask for instruction.

Delay Analysis Forensic Planning Report Writing

I have worked on Claims through the years, and I just want to ask everyones opinion, regarding report writing; some companies I have worked for have written massive report documentation, supported with background data of meetings, memos, emails..etc. On the other side of the coin I have been involved in claims where, the report has been as simple as a straight time line, supported and balanced against the project program, and emails.
