EOT Claim

Hi all,

In a remeasurable contract, can the contractor claim for EOT based on more work required during execution than planned. or a new basline(time) to be fixed accordingly, everytime the planned quantity changes?

For eg:

In the plan, there was 40LM of cable pulling. now during the execution it changed to 100LM and required more time to complete the work (assuming with the same resource as planned in baseline). This delayed the termination of cables, testing & commissioning etc and the contract completion date. can the contractor raise a claim for EOT?

Time Impact Analysis on as-planned programme

Hi all,

Recently I received a programme, which is scheduled to complete before the contractual completion, say 30 days before, and a buffer activity(30 days) is inserted to meet the contract completion date.

I would like to have your views in case of a delay event in the beginning stage of the project. For eg as follows,

1. Client didn't allot the site to the Contractor as per baseline(say 15 days delay).

Evaluation of EOT Claim and Actual Manpower

All, The contractor submitted an EOT based on impacted as planned method.I evaluated using the same method and found out that Contractor is right for the number of days claimed.Looking on the actual manpower vs. planned manpower, Contractor has only 20 men out of 100 men on the impacted activity. As a consultant, is it possible to reject Contractor's EOT claim because their actual manpower is less than what was planned? Thanks in advance

NEC Clause 62.2 - Delay to Planned Completion

Can anyone tell me of any case law or precedent that states which accepted programme is to be used during the assessment of a compensation event?

If it is retrospective (with agreement to be done retrospectively), should the accepted programme at the time of the CE occuring be used or,  should the the accepted programme at the time the CE was notified be used?
