Prolongation costs in case of pacing delays

Hi

If a contractor decided himself to pace non affected work with ongong affected works, whether he would be eligible for prolongation costs? Or his delay in non affected areas woul be treated as concurrent delays that will not entitle him any prolongation costs?

Prolongation/Disruption Cost

K
Kannan CP 👤 Member for 17 years 11 months

Hi All,

I have the following scenario to discuss.

1. In the schedule, through the Path 1 the Employer delay event impact the progress of the Contractor. The Contractor uses heavy machine (high rent cost) to execute the activity. Due to the delay by Employer, it took 1 month more than the planned date.

2. In the mean time, through Path 2 there is concurrent delay from the Contractor which leads to the project completion date. Eventhough there is link between Path1 and Path 2 activity, the Path1 will not be driving.

concurrent delays

K
Kannan CP 👤 Member for 17 years 11 months

Hi All,

Can I request the opinion of the experts for the below claim situation.

1. The Contractor is in delay and beyond the Contract Completion Date.

2. In the mean time, there is a delay event from Employer (for eg: permission of Power). But even after the closing of Employer delay event (within the contract completion date), the Contractor is still not ready to receive the power because of its delay. Therefore at present the Employer event is not in the Critical Path.

Delay in site handover to Contractor

K
Kannan CP 👤 Member for 17 years 11 months

Hi All,

The situation for EOT as follows;

There is a delay in the hand over of site to the Contractor, but as a part of mitigation the Contractor started the setting out works ahead of the official site handover-     Can the Employer deduct the time of Setting Out from the delay analysis?

Kannan

Books on Delay Analysis

C
C S 👤 Member for 11 years 3 months

Hi There,

I am just wondering if there are any books that people would recommend that provide a mid level discussion and explanaton of delay analysis and the techniques involved. It would be very useful if any of these books also contained a relatively detailed explanation of the steps to be followed for each delay analysis method.

Thanks in advance

Delay event notice from Contractor

K
Kannan CP 👤 Member for 17 years 11 months

Dear All,

Is it allowed as per FIDIC, for a Contractor to submit the detailed claim (WITHOUT A NOTICE) within 28 days after the Contractor became aware of the event.

For eg: the Contractor submitted the impacted schedule with delay event/supporting documents soon after they became aware that the Employer delay is started affecting the Contract Completion date.

Can the Emplyer reject the claim by saying that the Contractor didn't submit the notice of delay and directly submit the claim with the TIA programme.
