Extension of Time (Bad weather condition )

Dear All

There was a work stoppage for 3 days due to bad weather and it took 3 days to back to the normal condition.

Client Intent to give an extension of time for 3 days without cost but the updated program showing no delays.

Is the contractor eligible for the Extension of time ???

Hi Arun

Beware of a contract which limits the method of claiming an EoT.

If that method does not work and an eoT claim is impossible then time would be set at large.

Normally any extension of time for weather must be on the basis of it being exceptionally inclement.

In other words worse than expected.

Expected wetaher delays should be built into the programme on the basis of Non Work days in the calendar.

If the contractor hasn't done so then the actual weather stoppage could be used as a way of reducing a claim 9of whatever cause) when it arises

Whether they are entitled or not, is written into the contract, not the program. The program is the tool used to demonstrate the value of the entitlement, if such exists.

The conctract  will also specify the method that must be used to demonstrate the impact of the delay, how and when it must be communicated.
