A daywork schedule is commonly included within a tender package in order to agree as part of the contract the rates for various time-related activities.
Generally, variations to contract would be valued under one of the 4 headings, in this order;
1 BQ rates
2 Rates derived therefrom
3 Fair value agreed
4 Dayworks
Notice that dayworks is relagated to the last option - this is because it can tend to lead to over-valuation of the work, especially when the need to progress the work with any haste is removed (the longer it takes, the more is to be paid!).
Notwithstanding the reluctance of the Employer to pay dayworks, sometimes it is necessary as it is not possible to value the work under any other heading. Whilst the rates should reflect the level of pricing in the original tender, this is often diffcult to establish and inevitably disagreement will arise. So it is better to set out a schedule of daywork rates and agree these as part of the tender.
