It depends really on the provisions (the whole mechanism of claim and LD) of the Contract.
Has the Contractor complied with the requirements of the Contract (such as notices, and submission and justification of the EOT cliam itself)? It is then the ERs duty to reply. Also, for the ER to impose LD, he needs to issue CNC.

Yes, the Employer can apply LDs without giving Exetension of Time under the Contract.
