Dear Bal,
It depends on the Contract Conditions. If it is a FIDIC contract, then the latest Date of Commencement is 42 days after the signing of the agreement.
You should have submitted a Program of Works within 28 days from that date (June 18) showing the scope of works and date of completion.
Then you do a delay analysis by showing the results of the following:
Agreement: May 8, 2008
+42 days
Commencement Date: June 18, 2008
Actual start of work at site: October 05, 2008
Critical Activity path delayed by: 109 days
You have to check your contract and the compensation claused for actions that you can take.
