NEC3 ECSC OPTION B COMPENSATION EVENT HELP!

HI. Need help. PM has rejected the below compensation events! Do i have a case if i take it to an adjudicator/court?

 

Compensation Event #1

Clause: 60.1

The following are compensation events.

 

(1) The Project Manager gives an instruction changing the Works Information except

 

·         a change made in order to correct a Defect or

Chaos, complexity, and CPM

I am just starting to explore chaos theory (Jame Gleick - "Chaos:making a new science) and it struck me that it may have some inplications in what we do when we try to control EPC projects with too much detail.  The current thinking is that with greater detail/complexity, project managers/controllers/schedulers gain greater control.  My long-held position is that just the opposite is true - we are better off aggregating data instead of reducing it to its primary element(s).

Status of Finish Date

Dear All

1-      Once the Contractor has submitted an Interim EoT Claim

2-      The Engineer has accepted that to review

3-      Responds to the contractor that the claim is being reviewed

The contractual / revised finish date is considered withhold / null & void (can no more be considered as Contractual).

Is the above statement right? Either case please provide some reference and evidence if possible

Multiple NEC contracts one project

If an early warning/compensation event delays contractor A to the extent that it will delay contractor B is contractor B entitled to a compensation event. If contractor b has not started on site I assume he can not claim an extension to his contract and hence additional costs as his whole contract period has moved as a block

Construction Methodology for Structural Steel with Deck Slab Concreting

Hello Everybody,

We are doing a Commercial Project comprises (B+G+2Typ+LHR) having Structural Steel Building with Deck Slab Concreting

Our payment conditions are released based on milestones for seperate floors, and each mile stone will be upon the completion of Structural steel (Vertical & Horizantal members), RCC Completion ( Column Encasing & Deck Slab Concreting)

So, I have prepared 2 different options:
