If incorporating these delays on a certain data date and the result were 60 days(behind) , where the same updated program (monthly) resulted 40 days (behind) before incorporating delays.

this means that the contractor is entitle for 60 days EOT with associated cost for 20 days only.

i.e for time we have to grant the contractor the complete duration including the period of concurrent delay ,but to evaluate the cost ,we have to deduct the cost of the concurrent delay period.

GOOD LUCK.

The point is , the sub-contractor did not submit any helpful date to allow the assisment and also not within the time frame as the contract reads so their claims can be rejected (contractually) but somehow this is will not be of a good vlaue to the project to apply penalties at this time,

now as u said

1- if incorporating these delays on a certain data date and the result were 60 days(behind) , where the same updated program (monthly) resulted 40 days (behind) before incorporating delays, meaning the E.O.T is 20 days

is that what u mean???

if yes, what about the 40 days delayed already due to lack of resources at the same data date??

If,thos delay events have not occured on the same time and they were along the project duration you can do the following:-

*For each delay events you have to submit official notification to the client and reserve your right to claim for EOT and associated costs.

*If, you do not like to submit separate claim for each delay event at the time of occurence(which is logic due to the diffeculties in preparing a claim with all the history, details and supporting documents,so, you can collect a group of delay events at considrable period and submit the impact of thos grroup of delay event at specifif data date .

*So, at the selected data date, do up date for the work programe use the actual start date and actual finish date and the actual % completed foe each activities.

*From the above updated programme you can show the impact of thos group of delay events and you can submit your claim for entrim EOT at specific data date taking into consideration that any delay events ,variations or addetional works may happend afer the said data date shall be studied and claimed separetly.

*At the end of the proect ,you can collect all delay events, addetional works and variations and study the impact of all thos events on the last up dated appproed progamme.

*The total granteed EOT shall be grater than or equal to the sum of all entrim EOT .
