Dear Members,

In a Lump sum contract for buildings ( G+4,G+5 )there is an item namely plastering shafts.In the cotract this plastering is mentioned for MEP shafts.As this plastering work is for internal and external and the Contactor has done the plastring work for external surface of MEP shfts ( Diamension of shaft is 60cm X 20cm )and the internal space is not able to plaster, the contractor has not done that work.
My question is, Is the Client insist to make a variation for the deletion of internal plaster for this MEP shaft,Eventhough it is not practical to do the work,any provision for the Cotractor in FIDIC, furnishing that these small inside area to be not considered.( In contract drawing it is not mensioned specifically inside plastering but mensioned only MEP shaft and the contractor done external plastering.
Please advise.

If the contract drawings did not expressly require that the inside of the shaft be plastered it is reasonble that the contractor did not allow for doing it. Furthermore if it is impractical then why do it? You cannot contract to do something that is impossible.
I do not thing that the contractor should have any money deducted from his original estimate.

Hi,

Is it best to refer back to what your contract said whether there is any provision clause for the Client to omit out any portion of the work and yet the contractor is not allow to claim for lost of profit or whatsoever..

My current project have the same case and is written clearly in the contract :( nothings much can be done , except to pull out the neck and let them cut :(
