(2) It's also good to get feedback when a solution is found, return to the original post to explain how it was resolved so that more people can also use the results.

Dear Samer Zawaydeh & Other colleaques,

If I may ask, what are the documents that constitute contract documents in COnstruction contract? in what precendence are they cited?

Hi Jamil

The difference is there in the words.

Shop drawings are those prepared by the manufacturer so that the actual items can be put together in the workshop.

They are the next stage in design from engineers drawings that have been "approved for construction"

Shop drawings usually have to be submitted for approval so they in turn may become "approved for construction".

Hi everyone

With regards to this order of precedence of contract document, may I ask what it says about the drawings.?

I means, If there is discepancies between layouts, details, schedule, genral notes, general details, etc.. what will be the order of precedence?

Thank you for your kind question.

I am going to reply with listing the documents as per the FIDIC 1999 RED book. Which is the Conditions of Contract that is used when the Design is submitted by the Employer and the Construction is done by the Contractor.

Clause 1.5, page 6, FIDIC RED BOOK 1999;
" The documents forming the Contract are to be taken as mutually explanatory of one another. For the purposes of interpretation, the priority of the documents shall be in accordance with the following sequence:

(a) the Contract Agreement (if any)
(b) the Letter of Acceptance,
(c) the Letter of Tender,
(d) the Particular Conditions,
(e) the General Conditions,
(f) the Specification,
(g) the Drawings, and
(h) the Schedule and any other documents forming part of the Contract.

If an ambiguity or discrepancy is found in the documents, the Engineer shall issue any necessary clarification or instruction.
"

I hope that the answer above is clear and complete. If you have another form of contract you are using in Oman, please check the General Conditions, usually it states the documents and its order. If you have any other question, please let us know.

You seem to be a bit overqualified to use this forum - nevertheles:

The contract documents are usually listed in an addendum with their order of priority.

As a rule of thumb written words takes priority over published printed text.

If there is any confusion then the rule of Contra proferentum applies.
