Tips on using this forum..

(1) Explain your problem, don't simply post "This isn't working". What were you doing when you faced the problem? What have you tried to resolve - did you look for a solution using "Search" ? Has it happened just once or several times?

(2) It's also good to get feedback when a solution is found, return to the original post to explain how it was resolved so that more people can also use the results.

if a claim occurs due the late nomination of nominated subcontractor; often contractors notify the claim within 7 days from the occurrence of the claim with an impacted program showing the delay of activities. But they don’t substantiate their claim “Costwise “within 28 days , since it requires lot of analysis and work to do for knowing the exact cost.

I want to know even if we are not substantiated our claim cost wise within 28 days are we eligible for the claim if we substantiate later than 28 days ?????

Do consultants have the right to reject our claim if we substantiate later???????

Do justify??????????????

Haresh,

What does your contract say? Time limits may bar a claim if notice is not given in time, but it would be very unusual that a claim is barred because other additional information has not been given within the notice time scale. As you correctly say, it may not be possible to give such other information in time.

Some contracts may have a time limit for the notice and another time limit for further information to be given but even if the further information is not given in time, it would normally be incumbent on the contract administrator to assess the claim on the information he has got.
